These Terms and Conditions govern the “Free SmartSite Build” offer provided by Zexora Media. By claiming this offer, the client agrees to all terms listed below. If the client does not agree, they must not use or request the service.
Zexora Media reserves the right to update these Terms at any time.
Zexora Media will provide the following items free of charge:
Included (Free):
SmartSite Website Build
Automated Lead Capture System
Smart Live-Chat Widget
SEO Starter Setup
Three months free hosting
One Premium Feature (client may choose ONE of):
• Appointment Booking System
• Social Media Planner
• Review Automation System
No other features, tools, functionality, or services are included unless explicitly agreed in writing.
The following are not included under the free offer:
• Additional website pages
• Brand design, logos, photography
• Custom development
• CRM customization beyond the default setup
• Email setup
• Paid advertising services
• Social media content creation
• Ongoing marketing work
• Additional automations or integrations
• Any feature not listed in Section 2
If requested, charges may apply, and pricing will be provided separately.
The client acknowledges they cannot expect any additional work unless agreed in writing.
To deliver the SmartSite, the client must provide timely access and information, including:
• Business information (name, address, services, pricing)
• Branding assets (logo, colours, images)
• Domain registrar access (if applicable)
• Any required login credentials
• Approval of website content
• Responses to communication within a reasonable timeframe
If the client fails to provide required information, Zexora Media may pause or terminate the project (see Section 11).
Zexora Media will store client data within a secure third-party marketing and automation system (unnamed).
Client data includes:
• Website leads
• Form submissions
• Chat messages
• Booking data
• Analytics
Both Zexora Media and the client will have access to this data.
Data collected may be used by Zexora Media for performance analysis, marketing, and internal optimisation unless the client opts out in writing.
All data is processed in compliance with UK data privacy laws.
By using the Free SmartSite offer, the client grants Zexora Media the right to:
• Use aggregated, anonymised data for marketing and case studies
• Reference performance outcomes (without exposing private details)
• Display the final SmartSite build in Zexora Media’s portfolio and advertising
If the client does not want their business showcased, they must request removal in writing.
The client acknowledges and agrees:
• Zexora Media does not guarantee leads, customers, revenue, ranking, growth, or performance.
• Website features, automations, or tools may change, break, or update over time.
• No outcome is promised—this is a “best-effort” service provided free of charge.
The client accepts full responsibility for business results.
The SmartSite includes three (3) months of free hosting.
After this period:
• Hosting continues at £22 per month
• Hosting must be paid on time to keep Smart features active
• If hosting is not paid, the website may be disabled until payment is made
The client may move the website to another hosting provider at any time.
However:
• Smart features may stop functioning
• Automations may break
• Lead capture forms may fail
• Chat widget and premium features will likely stop working
Zexora Media is not responsible for failures or issues after migration.
The website’s static structure will continue to work, but Smart functionality cannot be guaranteed.
If the free SmartSite begins consuming significant technical or operational resources, Zexora Media reserves the right to:
• Charge a small maintenance fee, OR
• Recommend downgrade/removal of heavy features, OR
• Allow the client to migrate the website elsewhere at no cost
No forced charges will ever be applied without prior notice.
Zexora Media may terminate the free website offer at any time in the following cases:
• The client becomes uncooperative
• The client is abusive or unreasonable
• The client fails to respond for 7 days
• The client refuses to provide required information
• The client violates any part of these Terms
Termination results in immediate cancellation of work.
No compensation is owed because the service is free.
Zexora Media also reserves the legal right to withdraw the offer at any time with no consequences.
Because the SmartSite is free, there are no refunds.
For paid add-ons or upgrades:
• All payments are final
• No refunds are provided
• Work begins once payment is received
Zexora Media may offer:
• Additional features
• Marketing services
• Paid upgrades
• Monthly retainers
• Advertising packages
The client has no obligation to purchase any paid services.
To the fullest extent allowed by law:
• Zexora Media is not liable for any business losses
• Not liable for downtime, bugs, errors, or feature failures
• Not liable for issues caused by third-party platforms
• Not liable for lost revenue, profits, or opportunities
• Not liable for issues arising from client negligence or delays
The client agrees to use the SmartSite “as is.”
These Terms are governed by the laws of England and Wales.
Any disputes will be resolved exclusively in UK courts.
By claiming a Free SmartSite, the client confirms they have read, understood, and agreed to all Terms above.
